You are likely already aware of the recent decision by the Auckland Council to charge holiday home owners business and targeted rates on top of their residential rates.

On behalf of the holiday home industry, we have taken advice on the legality of what the Council has done and are currently seeking further clarification from lawyers on the options we have available to us to protect your rights as a holiday home owner in Auckland and also for those around New Zealand. We have engaged our legal counsel to ascertain whether there is enough justification for a judicial review of the new rating policy.

Our advice suggests that the council has not followed a robust decision-making approach in implementing the new rates, and has come up with a flawed outcome. We do not believe the rate is fair or equitable nor do we believe council’s final policy for commercial rates is robust.
